Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the AI Campaigns website and services ("Service") operated by AI Campaigns ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

AI Campaigns provides an AI-powered platform for generating social media marketing campaigns, including SEO-optimized captions, hashtags, visual content concepts, AI-generated images, and posting schedules for multiple social media platforms including Instagram, TikTok, Facebook, X (Twitter), Reddit, LinkedIn, Quora, and Tumblr.

2. Eligibility

To use our Service, you must:

  • Be at least 13 years of age (or the applicable age of digital consent in your jurisdiction)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account use
  • Be legally permitted to use such services in your jurisdiction

3. Acceptable Use Policy

You agree to use our Service only for lawful purposes. You must NOT use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or harassing
  • Produce hate speech, discriminatory, or offensive content
  • Create spam or unsolicited advertising campaigns
  • Violate any third-party intellectual property rights
  • Attempt to reverse-engineer, decompile, or exploit the platform
  • Distribute malware, viruses, or harmful code
  • Generate misleading, false, or deceptive content
  • Impersonate any person, company, or entity
  • Engage in any activity that violates applicable platform policies (e.g., Instagram, TikTok community guidelines)

4. Intellectual Property Rights

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of AI Campaigns and its licensors.

You retain ownership of any original content you input into the Service. For AI-generated content created using our platform, you are granted a non-exclusive license to use, modify, and publish such content. By using the Service, you grant us a limited license to process your inputs to deliver the Service.

5. AI-Generated Content Disclaimer

AI-generated content is provided "as-is." You are solely responsible for reviewing, editing, and ensuring that any generated content meets your requirements and complies with applicable laws, regulations, and platform-specific community guidelines before publishing. We make no guarantees about the accuracy, completeness, legality, or suitability of AI-generated content for any specific purpose.

6. Subscriptions and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to the following:

  • Subscriptions are billed in advance on a monthly or annual basis
  • Subscriptions automatically renew unless cancelled before the renewal date
  • All fees are non-refundable except as required by law
  • Prices may change with 30 days' prior notice
  • Payments are processed securely via Stripe
  • You are responsible for all applicable taxes

7. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share information about you when you use our Services. By using the Service, you agree to our Privacy Policy.

8. Third-Party Services and Advertising

Our Service may display advertisements served by Google AdSense and other third-party advertising networks. These third parties may use cookies and similar tracking technologies to serve relevant advertisements. We are not responsible for the content of third-party advertisements or the privacy practices of advertising partners. Users may opt out of personalized advertising by visiting Google's Ads Settings.

9. Service Availability and Modifications

We strive to provide reliable, uninterrupted service but do not guarantee 100% uptime. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI CAMPAIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless AI Campaigns and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may cancel your account at any time through your account settings or by contacting us.

14. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in courts of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
